Welcome to Maliyha Serenady & Co. By accessing this website, requesting a quote, booking services, renting equipment, or making a payment, you agree to the following Terms & Conditions.

1. Booking & Reservations

A signed rental agreement and required retainer payment may be required to secure your reservation.

Reservations are not guaranteed until confirmed by Maliyha Serenady & Co.

All pricing is subject to change without notice until a booking is confirmed.

2. Payments

A non-refundable retainer is required to reserve rental equipment and services.

The remaining balance is due on or before the event date unless otherwise agreed in writing.

Failure to make timely payments may result in cancellation of services.

Returned checks may be subject to additional fees.

3. Delivery & Pickup

Delivery fees may apply based on location.

Customer grants Maliyha Serenady & Co. permission to enter the event property for delivery, setup, service, and pickup.

Rental equipment must remain at the delivery address listed on the rental agreement.

Customer is responsible for ensuring clear access to the delivery and setup area.

Additional fees may apply for stairs, long walking distances, inaccessible areas, delays, or special accommodations.

4. Setup & Breakdown

Delivery and setup are separate services.

Setup services must be arranged in advance and may incur additional charges.

Customer agrees to have the event space clean, accessible, and ready for installation before arrival.

Maliyha Serenady & Co. reserves the right to refuse setup in unsafe conditions.

5. Equipment Responsibility

Customer assumes full responsibility for all rental equipment from the time of delivery until pickup.

Customer agrees to protect equipment from:

• Theft

• Vandalism

• Damage

• Weather exposure

• Negligence

• Misuse

Customer is responsible for any repair or replacement costs resulting from damage, loss, or theft.

6. Bounce House Safety

Adult supervision is required at all times.

Maximum occupancy and weight limits must be followed.

No shoes, food, drinks, gum, pets, face paint, glitter, roughhousing, flips, or unsafe behavior are permitted.

Bounce houses must not be used during rain, lightning, high winds, or severe weather.

Maliyha Serenady & Co. reserves the right to discontinue operation if unsafe conditions exist.

7. Concession Equipment

Customers agree to operate concession equipment according to all instructions provided.

Machines may become hot during use.

Customers assume responsibility for injuries, burns, or damages resulting from misuse.

Attendant services are available for an additional fee.

8. Balloon Décor

Balloon décor becomes the customer's responsibility upon installation.

Outdoor balloon installations are subject to weather, temperature changes, wind, sunlight, and environmental conditions.

Maliyha Serenady & Co. does not guarantee balloon longevity after installation.

No refunds are provided for balloon failures caused by weather or customer handling.

9. Photo Booth & 360 Booth Services

Guests participate at their own risk.

Customer is responsible for guest conduct.

Adequate space and electrical access must be provided.

Maliyha Serenady & Co. is not responsible for technical interruptions caused by venue power issues, internet disruptions, guest misuse, or circumstances beyond our control.

10. Weather Policy

Safety is our priority.

Maliyha Serenady & Co. reserves the right to suspend, remove, postpone, or cancel rentals due to:

• High winds

• Lightning

• Heavy rain

• Flooding

• Extreme temperatures

• Unsafe site conditions

Weather-related cancellations may be eligible for rescheduling or account credit. Refunds are not guaranteed.

11. Permits & Licenses

Customer is solely responsible for obtaining any permits, licenses, permissions, HOA approvals, venue approvals, or governmental authorizations required for the event.

12. No Warranty

All rental equipment is provided "as is."

Maliyha Serenady & Co. makes no warranties, express or implied, regarding the condition, merchantability, fitness, capacity, or performance of rental equipment.

13. Limitation of Liability

To the fullest extent permitted by law, Maliyha Serenady & Co., its owners, employees, contractors, attendants, and affiliates shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising from:

• Equipment use

• Equipment malfunction

• Event interruption

• Property damage

• Personal injury

• Illness

• Death

• Weather conditions

• Customer negligence

14. Indemnification

Customer agrees to defend, indemnify, and hold harmless Maliyha Serenady & Co., its owners, employees, contractors, attendants, and agents from all claims, losses, liabilities, damages, expenses, attorney fees, and lawsuits arising from the use of rental equipment, services, or event activities.

15. Refund & Cancellation Policy

A non-refundable retainer is required to reserve equipment and services.

Cancellations made 30 or more days before the event may be eligible for a partial refund excluding the retainer.

Cancellations within 14 days of the event are non-refundable.

Custom balloon décor payments are non-refundable.

No refunds are issued for unused rentals, early pickups, guest count changes, or same-day cancellations.

16. Photography & Marketing

Unless otherwise requested in writing, Maliyha Serenady & Co. may photograph completed setups, décor, and rental displays for marketing, promotional, portfolio, website, and social media purposes.

Customer names and personal information will not be publicly disclosed without consent.

17. Website Use

All content on this website, including logos, graphics, photographs, designs, text, pricing, and branding materials, is the property of Maliyha Serenady & Co. and may not be copied, reproduced, or distributed without written permission.

18. Agreement

By using this website, requesting services, making a payment, or signing a rental agreement, you acknowledge that you have read, understood, and agreed to these Terms & Conditions.
